Bylaws to the Clinical Oncology Research Conflict of Interest Policy (ver.1)


Article 1  Presentations at the Japan Society of Clinical Oncology’s Academic Conferences and Other Venues

Scope of Disclosure
Conflicts of interest that presenting authors are obligated to disclose are limited to matters in connection with companies or for-profit organizations connected with the presentation content.

At the Time of Abstract Submission
Presenters who give presentations of lectures at academic conferences, symposia, lecture meetings, open lectures for the general public, or other venues of the Japan Society of Clinical Oncology (hereinafter the "Society") shall clearly indicate at the time of title submission or abstract submission whether the presenting author has had any conflicts of interest within the past one-year period.

At the Time of Presentation
With regard to conflicts of interest to be clearly indicated at the time of presentation, presenters shall disclose in accordance with the Presenting Author Conflict of Interest Self-Declaration Form (Form 1) matters prescribed in IV. Matters Requiring Disclosure of the Clinical Oncology Research Conflict of Interest Policy (hereinafter the "Policy"). Matters for which disclosure is required shall be matters that occur from one year before abstract submission to the time of presentation; it is provided, however, that the amounts for which self-declaration is required are prescribed for each matter requiring disclosure as follows.

(1) Presenting authors who are officers or advisors of companies or for-profit organizations shall report annual remuneration from a single company or organization of 1 million yen or more.
(2) Presenting authors shall report stock ownership in cases where profit (the sum of dividends and profit on sale) from shares of a single company during a one-year period is 1,000,000 yen or more or where they own 5% or more of the total shares.
(3) Presenting authors shall report patent royalties or licensing fees from companies or for-profit organizations in cases where royalties or licensing fees for a single patent are 1,000,000 yen or more per year.
(4) Presenting authors shall report honoraria (such as lecture fees) paid by a company or for-profit organization as compensation for the time or labor of a researcher engaged for conference attendance (presentation) in cases where annual honoraria from a single company or organization are 500,000 yen or more.
(5) Presenting authors shall report manuscript fees paid from companies or for-profit organizations as compensation for writing for a pamphlet or other publication in cases where annual manuscript fees from a single company or organization are 500,000 yen or more.
(6) Presenting authors shall report research funding from companies or for-profit organizations provide in cases where the total amount of research funding paid for a single instance of clinical research is 2,000,000 yen or more. Presenting authors shall report scholarships (grants) in cases where the total annual amount paid to a single research leader from a single company or organization is 2,000,000 yen or more.
(7) Presenting authors shall report other remuneration (travel, gifts, or other in-kind payments not directly related to research) in cases where the annual remuneration received from a single company or organization is 50,000 yen or more.
(8) Presenting authors shall disclose information regarding “Acceptance of researchers from a company or for-profit organization” if such researchers are accepted from companies, etc.
(9) Presenting authors shall disclose information regarding “Endowed chairs offered by a company or for-profit organization” if such endowed chairs are part of those offered by companies, etc.

 

Article 2  Presentations in the Society’s Bulletin

Scope of Disclosure
Conflicts of interest that presenting authors are obligated to disclose are limited to matters in connection with companies or for-profit organizations connected with the submission content.

At the Time of Submission
Authors who make presentations in the Society’s bulletin International Journal of Clinical Oncology (IJCO) or other publications must clearly indicate at the time of submission any conflicts of interest by means of Self-reported Potential Conflict of Interest of Authors (Form 2: refer to Instruction to Authors), which is prescribed in the Instructions to Authors. Form 2 appears in the publication at the end of a research paper immediately before the references. In cases where no regulated conflict of interest exists, wording such as "The authors indicated no potential conflict of interest" is inserted in the space. With regard to conflicts of interest to be clearly indicated at the time of submission, authors shall disclose matters prescribed in IV. Matters Requiring Disclosure of the Policy. With regard to individual matters for which disclosure is required, the amounts for which self-declaration is required shall be the same as the amounts stipulated in Article 1 of these Bylaws. Matters for which disclosure is required shall be matters that occur from one year before paper submission to the time of submission. Authors shall submit self-declaration forms in an equivalent format for presentations in the Society’s publications other than IJCO as well.

 

Article 3  Officers, Committee Chairmen, Ethics Committee Members, and Conflict of Interest Committee Members

Scope of Disclosure and Publication
Conflicts of interest that officers, committee chairmen, ethics committee members, and conflict of interest committee members have an obligation to disclose and publish are limited to matters in connection with companies or for-profit organizations related to undertakings of the Society.

At the Time of Assumption of Office
The Society’s officers, committee chairmen, ethics committee members, conflict of interest committee members must submit the Officers, Committee Chairmen, Ethics Committee Members, Conflict of Interest Committee Member Conflict of Interest Self-Declaration Form (Form 3) at the time they assume office and once each year after assuming office. In the event a new conflict of interest arises during the term of office, they shall have the obligation to report using Form 3 within six weeks. With regard to conflicts of interest disclosed and published using Form 3, matters prescribed in IV. Matters Requiring Disclosure of the Policy shall be self-declared. The amounts for which self-declaration is required for individual matters for which disclosure is required shall be the same as the amounts stipulated in Article 1 of these Bylaws. Individuals shall fill out Form 3 for a period of one year and clearly indicate the calculation period. At the time of assumption of office, individuals shall disclose by self-declaration conflicts of interest going back two years from the date of assumption of office, preparing and submitting one copy of Form 3 for the one-year period beginning two years before assumption of office and one copy for the one-year period before assumption of office.

 

Article 4  Handling of Conflict of Interest Self-Declarations of Officers, Committee Chairmen, Ethics Committee Members, and Conflict of Interest Committee Members

At the Society’s Secretariat, the Chairman of the Board shall be custodian of the completed copies of Form 3 submitted to the Society in accordance with these Bylaws and conflicts of interest disclosed therein (conflict of interest information), and they shall be rigorously kept safe and managed as personal information. The Board of Directors and Conflict of Interest Committee may use conflict of interest information as needed for the disposition of matters stipulated in the Policy. In cases where doubts or social or legal problems about conflicts of interest of a declarer arise, that use shall include disclose within the Society or publication to society at large of the necessary scope of conflict of interest information after the consent of the Board of Directors has been obtained following discussion by the Conflict of Interest Committee. The retention period for completed copies of Form 3 shall be a period of two years after the completion of the term of office of officers, committee chairmen, ethics committee members, and conflict of interest committee members, after which time they shall be disposed of under the supervision of the Chairman of the Board; it is provided, however, that the disposal of Form 3 can be postponed by resolution of the Board of Directors if doubts or social or legal problems arise about a declarer.

(The Bylaws come into effect in April 2008.)
